What License Access means:
Licensed access to the Bar can be obtained through two separate routes. Either you are deemed to be an authorised licensed access client by virtue of the company’s membership of a certain professional body or the company holds a special license from the Bar Council. Either route allows the company to instruct barristers directly, without requiring a solicitor to act as an intermediary.
Professional organisations or individuals can instruct barristers, either on behalf of clients or on their own account, if they are deemed or adjudged suitable to do so because of their professional expertise.
The Licensed Access system allows an organisation or an individual, with particular expertise in particular areas of the law, to apply to the Bar Council to be licensed to instruct barristers directly in those areas, without the intervention of a solicitor. Some examples include charities and advice organisations, banks and other financial services institutions, insurers, NHS Trusts, professional indemnity organisations, fire brigades, the police and some private companies who need to instruct the bar regularly.
The license can cover advice or representation, or both, and permit licensees to instruct barristers either on their own affairs, or on behalf of their clients.
Fosters Legal Ltd has been granted a License by the Bar standard Board, therefore the above means that we can instruct a barrister of your choice directly without the need of a solicitors’ firm. However there are still some cases and situations in which you will need to instruct a solicitor’s firm or another intermediary as well as a barrister. Because we have partnered and maintain excellent working relationships with other firms of solicitors in order to continue with complex cases, we are able to advise fully on matters to ensure you receive the best service possible.
